These Terms of Service ("Terms") govern your access to and use of the DomainBoar website located at domainboar.com ("Website", "Service"), operated by Jakub Przybyt, trading under the brand name DomainBoar ("we", "us", "our"), a natural person conducting activities on a non-registered basis (działalność nierejestrowana) under Polish law, resident in Poland.
By accessing or using this Website, submitting an inquiry, or contacting us in connection with a domain acquisition, you ("User", "you") agree to be bound by these Terms. If you do not agree to these Terms, please discontinue use of the Website immediately.
These Terms are legally binding. If you are accessing the Website on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms, in which case "you" refers to that entity.
DomainBoar is an informational portfolio website. We display domain names which we own and offer for sale. The Website itself does not process payments, conclude sales contracts, or transfer domain names. All transactions are conducted exclusively through authorised third-party domain marketplaces and registrars, including but not limited to Afternic, Dynadot, Spaceship, Sedo, and Atom ("Marketplace Platforms").
The display of domain names on this Website, including any associated descriptions, category labels, or external marketplace links, constitutes an invitation to treat (invitatio ad offerendum) under applicable law, not a binding offer. No contract for the sale of a domain name is formed through your use of this Website. A binding agreement arises only upon written confirmation by us following mutual agreement on price and terms, or upon completion of a transaction through a Marketplace Platform in accordance with that platform's terms.
Domain names displayed on this Website are offered for sale but may sell, be withdrawn from sale, or have their status changed at any time without prior notice. We make no guarantee that any domain name displayed as "Available" will remain available at the time you seek to complete a purchase. Status indicators on the Website (Available, Under Negotiation, Sold) are updated on a best-efforts basis and may not reflect real-time conditions on Marketplace Platforms.
When you click an external link from this Website to a Marketplace Platform, you leave the DomainBoar Website and enter a separate service governed by that platform's own terms of service, privacy policy, and operating rules. We are not a party to and accept no responsibility for transactions, disputes, technical failures, pricing changes, or any other events occurring on Marketplace Platforms.
Submitting an inquiry through the contact form on this Website does not create a binding contract, reservation, or option to purchase any domain name. An inquiry is a request to open a dialogue and does not confer any right to acquire the domain at any particular price or on any particular terms.
We endeavour to respond to all genuine inquiries within 48 hours on business days. We are not obligated to respond to inquiries that are incomplete, automated, abusive, or submitted in bad faith. Receipt of your inquiry does not guarantee that the relevant domain remains available.
By submitting an inquiry, you represent that the name and email address you provide are accurate and belong to you or your organisation. You must not submit inquiries using false, misleading, or third-party contact details without authorisation.
You must not use automated scripts, bots, or any other automated means to submit inquiries or interact with the Website. We reserve the right to reject, ignore, or take technical measures against submissions we reasonably determine to be automated or submitted in bad faith.
All content on this Website, including but not limited to text, descriptions, graphics, logos, the DomainBoar name and brand identity, and the overall presentation and layout of the portfolio, is the intellectual property of Jakub Przybyt / DomainBoar and is protected by copyright, trademark, and other applicable intellectual property laws.
The domain names displayed in our portfolio are assets owned by us. Their display on the Website does not transfer any rights in or to those domain names to you. All rights in the domain names remain exclusively ours until a sale is lawfully completed.
You may view and access the Website for the purpose of evaluating domains for potential acquisition. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the Website without our prior written consent.
We do not represent or warrant that any domain name in our portfolio is free from third-party intellectual property rights, including trademark rights. It is your sole responsibility to conduct appropriate trademark searches, legal due diligence, and clearance procedures before acquiring any domain name. We accept no liability for trademark disputes, UDRP proceedings, or legal claims arising from your acquisition or use of any domain name purchased from us.
You must not use this Website to:
Any descriptions, category labels, or commentary accompanying domain names on this Website are provided for informational and marketing purposes only. They do not constitute professional valuation opinions, financial advice, or investment advice. Domain name values are speculative and market-dependent. We make no representation that any domain will achieve a particular resale value or commercial outcome for you.
We do not guarantee that the Website will be available at all times, error-free, or free from interruption. We reserve the right to suspend, modify, or discontinue the Website or any part of it at any time without notice.
We endeavour to keep domain status information, descriptions, and external links accurate and up to date, but we make no warranty of accuracy, completeness, or timeliness. Information may be subject to change without notice.
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or in connection with your use of the Website, including but not limited to loss of revenue, loss of profits, loss of business, loss of data, or loss of goodwill, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising from or related to these Terms or your use of the Website shall not exceed the greater of (a) the amount you paid to us in the three months preceding the claim, or (b) EUR 100.
Nothing in these Terms limits or excludes liability which cannot lawfully be excluded or limited under applicable mandatory law, including consumer protection laws where applicable. Where you are a consumer resident within the European Union or the United Kingdom, statutory rights under applicable consumer protection legislation are not affected by these Terms.
This Section 7 applies to you if you are a natural person acting outside the course of your trade, business, craft, or profession ("Consumer") and you are resident in the European Union or the European Economic Area.
The Website provides an informational service. Because no payment is processed and no purchase contract is concluded through the Website itself, the EU Consumer Rights Directive (2011/83/EU) provisions on distance contracts and right of withdrawal apply to any sale concluded between us, not to use of the Website.
If and when we enter into a sale contract with you for a domain name, we will provide you with all pre-contractual information required by applicable EU consumer law before you are bound.
Domain names are digital content delivered electronically. Under Art. 16(m) of the EU Consumer Rights Directive, the right of withdrawal does not apply to contracts for the supply of digital content which is not supplied on a tangible medium where performance has begun with your prior express consent and acknowledgement that you thereby lose your right of withdrawal. Where applicable, we will seek this consent explicitly before completing any sale to a Consumer.
The European Commission provides an Online Dispute Resolution (ODR) platform for consumers: ec.europa.eu/consumers/odr. We are required to provide this link but are not obligated to participate in ODR procedures unless required by applicable law.
These Terms are governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions, and subject to applicable mandatory provisions of European Union law.
Subject to Section 7.5 and Section 8.3 below, any dispute arising from or in connection with these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the competent courts of Poland.
If you are a Consumer resident in the EU, you may also bring proceedings in the courts of your country of habitual residence pursuant to Art. 18 of Regulation (EU) 1215/2012 (Brussels I Recast). Nothing in these Terms deprives you of the protection afforded by mandatory provisions of the law of the country where you habitually reside.
For disputes with consumers, we are willing to participate in out-of-court dispute resolution procedures before the Inspekcja Handlowa (Trade Inspection Authority) or other authorised ADR entity under the Polish Act of 23 September 2016 on out-of-court resolution of consumer disputes. This does not affect your right to bring proceedings before a court.
We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. Continued use of the Website after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
If any provision of these Terms is held to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy & Cookies Policy, constitute the entire agreement between you and us regarding your use of the Website and supersede all prior agreements, representations, and understandings relating to the same subject matter.
